Some beauty lawsuit news

 

Olaplex CEO deems hair loss lawsuit as frivolous, excerpt from Business of Fashion

 

Though the lawsuit has not reached class action status, there are several disgruntled customers in Facebook groups claiming Olaplex has damaged their hair. One of the largest groups, “Olaplex Hair Loss/Hair Damage?” has 6,200 members. Davis opened a call for more potential clients to share if they believe they were injured by Olaplex products on her website through an “Olaplex Investigation Questionnaire.” Davis did not respond to requests for comment, but hair care litigation appears to be her focus; she currently has a pending case against Monat and previously brought a case against DevaCurl.

 

Previously, Olaplex responded to the suit with only a statement. “There are a wide variety of reasons for hair breakage or hair loss, as medical and scientific experts have publicly stated, including lifestyle, various medical conditions and medications, the aftereffects of Covid, skin conditions and more,” the company said on Feb. 9.

 

Founded in 2014, Olaplex is often credited with creating the prestige hair care category. In September 2021, the fast-growing brand raised $1.55 billion in its initial public offering, but the stock is down 70 percent from its IPO. In October, Olaplex cut its annual forecast, and is expecting sales between $704 million and $711 million in its next quarter. The brand will announce upcoming results on Feb. 28.

 

I'm going to have to eat my words because I was very skeptical of a lot of new accounts posting about hair loss here on BIC and we've all seen those false negative review campaigns in the beauty world - but it seems like this is a legit concern. I'm very sorry to those I expressed my skepticism to 😞

 

Sephora is a plaintiff in a class action over its Clean program, excerpt from New Beauty

 

The class-action lawsuit being filed against Sephora has arisen primarily as a result of the discrepancy between what consumers understand to be clean beauty and what Sephora is labeling as “clean.” According to the suit, the average consumer’s understanding of clean beauty products aligns with that of the dictionary definition of clean which reads as “free from impurities, or unnecessary and harmful components, and pure,” and thus, in the context of beauty, means that products are free of harmful or synthetic ingredients. However, the plaintiff found that “a significant percentage of products with the ‘Clean at Sephora’ [seal] contain ingredients inconsistent with how consumers understand the term,” one such example being the Saie Mascara 101 which, despite having the Clean seal, includes “numerous synthetic ingredients, several of which have been reported to cause possible harms.”

 

I always thought it was pretty clear that the Clean symbol referenced a very specific list of ingredients and did not meet the standard of say, scientific or medical guidance. We'll see how this labelling lawsuit turns out.

@pocketvenus  The Sephora lawsuit seems frivilous to me because on every page of a product that is part of Sephora's "clean" category, there is a detailed description of the ingredients that are *not* in each particular product.  If someone doesn't agree with that label, then reading well should have answered their concerns.

 

As for as the Olaplex lawsuit, I myself have not used Olaplex but once or twice.  However, I can believe there may be an ingredient that can cause hair loss in a number of people. as did Deva Curl (their cowash caused me to have some hair loss, I believe,) and Wen also.  I had read that co-washes may not exfoliate the scalp enough and somehow that can cause hair loss (I think.)  I found that true of Drunk Elephant's Co-wash too.  And not with any other type of shampoo.

 

Madison Reed hair coloring also has a class action lawsuit against it.  They advertise that they do not use harsh ammonia in their products, but they do use ethanolamine, which is known to cause hair loss.

 

Now this, this is a lawsuit I agree with.  After using it for years with no problem, a little over a year ago I lost the entire front section of my hair.  I mean, the whole section- from ear to ear.  As soon as I stopped using MR and started getting my hair done professionally, the loss immediately stopped and that hair is growing back.  Growing back curly, I might add.

It seems like olaplex might be a victim of their own success. Sell so much and eventually there will be people that hate it/don't get great results from it. That seems to lead to a lawsuit down the road.

@greeneyedgirl107 Ohhhhh I hope not! Even if it's just a marketing ploy, it still forces companies to at least think about these matters?? Like they now know there are skincare obsessives out there reading their ingredients lists and making purchasing decisions based on that and that's a part of the consumer base they need to account for? And consumers themselves might start thinking about ingredients lists?

@pocketvenus @greeneyedgirl107  Eh, I don't think "clean beauty" is the reason more customers have become INCI-savvy. Not the main reason, anyway. In fact, I see some "clean beauty" folks misunderstanding ingredients in general. Brands are simply reacting to purchasing trends, for better or worse. And the problem with "clean beauty" is that misinformation factor: I personally don't want cosmetics formulations driven by a consumer base that's been misinformed about "dirty" ingredients. It would be like having English dictionaries and widely used style guides (CMS, AP Style) driven by a group of readers who misunderstand certain words and phrases and want that info removed from reference materials. 

 

One big reason for increased ingredients scrutiny is the beauty/skincare influencer scene, plus dermatologists and chemists who've gone on social media to explain cosmetics topics and debunk misinformation. I especially appreciate any of them who've repeatedly said an INCI list doesn't tell you everything about a product and that formulation matters. 

 

Another reason is the availability of info on the internet at large. Sure, there's a lot of misinformation floating around. There's also a lot of valid and truthful info. It's become a lot easier to look up ingredients than it was 20 years ago.

@WinglessOne Yes, definitely I think we can see a rise in interest thanks to all the information we can access about different ingredients in so many different ways. For better or worse.

 

You raise a good point about the term clean because it totally implies certain ingredients are "dirty" which is so vague. Unlike the other terms like "green" or "vegan", the word "clean" also carries strong moral connotations and is linked to purity, while that which is dirty and impure activates the emotion of disgust. This way of categorizing carries over into other products too so we have this idea of "clean" eating - which of course implies "dirty" or even "bad" foods or foods you ought to feel guilty for consuming. It's now common for me to hear people saying they want to avoid chemicals as well. Of course what they mean is more specific, like carcinogens, but it's interesting to me that the word chemical is used in opposition to the category of "natural." Something chemical carries the taint of the industrial, what is mass-produced and processed, and it's interesting this is so strongly linked to what is harmful and not say, what is safer, more refined, more regulated - cleaner! 

 

I am observing a general sense in people that the environment is increasingly full of contaminants - both literal and figurative - they need to avoid. Like there's an increasing sense that what you buy is extremely consequential in terms of the "cleanliness" of your health, but also your morality. So buying "ethical" brands is now a consumer concern. Even though companies that stress their ethics in their branding, including those B Corp certified, are rarely transparent about labour relations or have engaged in illegal practices like union busting, so "ethical company" is as useful a term to me as "clean beauty." I sense a widespread desire to return to a time, both real and imaginary, where things are perceived as cleaner and better. Is modifying one's consumer behaviour a satisfactory way to address this generalized sense of ill? I'd say a resounding no but it's certainly very lucrative. And politically, it clearly has a very dangerous traction. Anyway, this is getting way more abstract than I'd intended!! All this to say is that the word clean is super loaded so I do wonder how this lawsuit will go.

@pocketvenus  I think you meant Sephora is a defendant. 😉 I chuckled when I first heard about the Sephora lawsuit. Though I loathe the entire "clean beauty" marketing scheme and the negative effect(s) it's having, I gotta say this lawsuit's probably a losing battle. If there was a "clean" government certification in the US, or maybe even an industry standard definition of "clean beauty," then maybe the plaintiff would have more ground to stand on. Maybe. But there's not, so it'll be hard to prove Sephora's own definition of "clean" doesn't apply to products it labels as such, and that Sephora's own definition is trumped by a dictionary's definition. 

 

(Resisting the strong urge to rant about "clean beauty" again.) 

 

About Olaplex: it'll be interesting to see if 1) this becomes class action and 2) how the plaintiffs plan to prove their case. I still doubt Olaplex is the cause of all those people's hair damage, but I'm not a scientist or dermatologist who can conduct any valid clinical studies to suggest one way or the other. And that's the only kind of evidence that would sway me, personally, away from using Olaplex No. 3.

@WinglessOne Lol yes, you're absolutely correct - Sephora is not [edit, omg I had to add the "not" - I'm so tired] the plaintiff! This lawsuit reminded me of the rise in greenwashing lawsuits but I cannot recall the outcomes of any of them. And again, I think Sephora has been really transparent that "Clean" means a pre-determined list of ingredients that you can evaluate on your own. The list is provided on every relevant product page. Though I can see if you never shop online, it's not so clear. Still, I would perceive Clean at Sephora as a marketing term and not an industry regulated one.

 

Also, agreed @CookieGirl1, Olaplex is [edit 2: I should've said "may" instead of "is". Sorry, I probably shouldn't have posted right when I got up today :P] not good for everyone and it stands to reason that products that produce strong results for some may potentially cause strong issues with others! But I think there is also a consumer expectation that there are safety regulations in place against more adverse effects like hair loss. I think ideally there would be both industry regulations and some material provided with the product to alert people if adverse requests are known. I'm assuming Olaplex hasn't already done this which is a little surprizing given the litigious landscape they're operating in...

Agreed: without a standard definition of “clean” that’s used throughout the cosmetics industry, it’ll be very hard for the plaintiff to claim Sephora’s own definition is wrong since that’s the definition Sephora customers are expected to use, not a dictionary's. If the plaintiff could compare Sephora’s definition to a cosmetics industry standard definition or, better yet, actual government certification requirements, then they could perhaps say Sephora’s not meeting the industry standard or certification reqs.

There’s no FDA certification or regulation of the terms “vegan” and “cruelty-free" either. But there are at least some cosmetics industry standards and non-government certification programs. (Leaping Bunny is the only one I care about.) Vegan is a lot easier for the general public to understand, though some things are still debated—honey, for instance. “Clean” is harder to understand because it’s too nebulous and based on fear mongering of allegedly dangerous “dirty” ingredients. Many customers simply define “clean” as “all natural, no chemicals,” which is impossible. Even Sephora’s own definition makes my eyes roll far enough back to read my brain. (Petrolatum, mineral oil, and parabens are on their list, for instance. Though I think for petrolatum, they’re trying to imply they do consider USP grade petrolatum as “clean.") 
 
Something I just noticed: Sephora’s product pages do list their “clean” definition but also say “this is not an exhaustive list” and “please see Clean at Sephora landing page for full list of specific restrictions and allowances by category.” But no link to that full list is offered on product pages. When I visit the Clean at Sephora landing page via site nav, I don’t get that full list. Instead, I just get a list of products. That’s a usability/site nav issue Sephora may want to address. (Hi, I’m forever stuck in UX design, usability, and compliance mode thanks to my former career.) 
 
The USDA regulates the term “organic” for food and cosmetics. I’m surprised “vegan” and/or “cruelty-free" hasn’t earned regulatory status yet; maybe the government doesn’t wanna deal with all the supply chain certification checks, I dunno. I really wish the FDA would step in and do something about “clean”: either define it for everyone or call it bunk. 
 
Meanwhile, the only thing this lawsuit might achieve is starting a roll of other challenges to the notion of “clean beauty,” and I’m in favor of that.

And it's so funny in my earlier response higher up in this thread, I'm thinking about how "clean" is this imaginary category in people's minds - no chemicals which is impossible. I gather what consumers are truly asking for is products that will be free of harm first and foremost to themselves. It is a reasonable expectation except like all categories, the category of safety can never be absolute and the vaguer the boundaries of a category, say the super vague "clean," the more inconsistency we'll have in the act of categorizing. With something as complex as skincare, there's going to be ingredients not so easily categorized. As well, some products, like skincare with higher concentrations of retinols, can be amazingly helpful to some and way too harsh for others. The Olaplex might be a good example of this.

@pocketvenus honestly, I'm sick of all of the Olaplex lawsuits.  Agreed, there are plenty of people who have experienced problems from the formula but that can literally be said about ANY product.  It's like finding that a specific foundation causes a person to break out; is it reasonable to sue the company that produces the foundation because you experienced an issue with it?  Should a person sue a grocery store for selling peanuts if that person has a nut allergy because the store is selling "harmful ingredients"?

 

Olaplex works well for plenty of people and while I'm sorry that a certain percentage of users have had issues, it disgusts me that this has blown so out of proportion.

Biossance discontinued their Glycolic Renewal mask. Kohls has some available.

 

A Biossance rep recommended the overnight mask by Pipette as a substitute. Pipette and Biossance are both brands of the same company.

@eshoe   I know!!  A friend of mine loved the tea tree mask, also discontinued.  I always knew my skin loved glycolic acid (I use The Ordinary's The Ordinary Glycolic Acid 7% Exfoliating and Brightening Daily Toner 8 oz/ 240 mL ,) but this Biossance mask is unbelievable!  Totally clear and smooth skin for three days.
