I can’t add it to my cart because it says coming soon. It’s still the same as when I asked my OG question. How do I order it if I can’t add it?

NO it is NOT AVAILABLE NOW -- and I have been Rouge since the Rougeprogram launched. Sephora's Rouge phone hotline customer service rep had zero knowledge about the product and kept arguing with me, saying all Sephora products are subscription only. Idiot! The manager she transferred me to said the item was sold out but it was never available to me and I was on the app ready to order half hour before Rouge promo launch. Anyhoo-- this is Sephora promotion and advertising fraud -- class action lawsuit stuff (and I run a marketing agency). Shame on Sephora.

The same thing happened to me all day yesterday. I am a Rouge and it kept saying "coming soon" although according to the fine print, it should have already been available. Now it is just "sold out" completely.

Lies -- even from Sephora mods. Shaking head. This is Sephora promotion and advertising fraud -- ditto for the 20 percent off promo promised for today that isn't being fulfilled to many many good women posting customer service complaints elsewhere here on Sephora message boards. Class action lawsuit waiting to happen.

California’s Laws

Here’s a snapshot of California’s laws regarding deceptive advertising:

California Business and Professions Code 17200: Defines unfair competition as, among other things, any unfair, deceptive, untrue or false. 

California Business and Professions Code 17500: Prohibits false and misleading advertising.

California Civil Code 1770: Lists a number of deceptive acts that are deemed to be unlawful, including, but not limited to, advertising goods or services with the intent not to sell them as advertised, and knowingly making untrue or misleading statements in advertisements.

Possible Penalties

Some of the penalties that fraudulent or deceptive advertisers may suffer in California include:

• Injunction

•  Up to $2,500 for each violation

• Up to six months in jail for each violation of the law against deceptive advertising
