Deceptive pricing practices are outlined in Section 74 of the Competition Act. Deceptive pricing occurs when a seller states prices or price savings that are not actually available to consumers. For example, firms cannot advertise a product at a low price, carry very limited stock, and then tell consumers that they’re out of the product so that they can entice them to switch to a higher-priced item. This “bait and switch” advertising is illegal in Canada. Firms must offer their customers “rain cheques” to avoid legal sanctions if advertised items are not stocked in sufficient quantities to cover expected demand. However, some deceptions are difficult for consumers to discern, such as when an airline advertises a low one-way fare that is available only with the purchase of a round-trip ticket, or when a retailer sets artificially high “regular” prices, and then announces “sale” prices close to its previous everyday prices.
